Thailand's Securities and Exchange Commission (SEC) has finalized regulations allowing cryptocurrency exchange-traded funds (ETFs) to trade on the country's main stock exchange, initially limiting eligible assets to Bitcoin (BTC) and Ether (ETH).

The new framework, which took effect on Oct. 16, 2026, permits crypto ETFs to be listed exclusively on the Stock Exchange of Thailand (SET), providing investors with a regulated way to gain cryptocurrency exposure through traditional brokerage accounts.

However, the rules initially exclude products linked to overseas crypto ETFs, including depositary receipts. Thai brokers will also remain restricted from facilitating investments in foreign crypto ETFs for retail clients, with access generally limited to institutional and ultra-high-net-worth investors.

Thailand opens stock market access to Bitcoin and Ether ETFs

The regulatory changes introduce a new investment channel for Thai investors who want exposure to Bitcoin and Ether without directly purchasing or holding cryptocurrencies. “For many investors, particularly those who have been cautious about opening an exchange account or managing a wallet, an ETF through their existing brokerage account removes a real barrier,” Binance Thailand CEO Nirun Fuwattananukul told Cointelegraph.

Alongside the new listing framework, the SEC has expanded the investment options available to mutual funds and private funds. Previously, these funds were permitted to invest only in foreign cryptocurrency ETFs. Under the revised regulations, they can also allocate capital to crypto ETFs established in Thailand.

However, launching such products will require issuers to complete several regulatory procedures, including fund registration, product approval, obtaining a SET listing and establishing appropriate custody arrangements.

Crypto ETF regulations introduce custody and investor protection requirements

The new framework includes safeguards intended to manage the risks associated with cryptocurrency investment products. Brokers will be prohibited from providing margin loans to finance crypto ETF purchases, while fund assets must be held by digital asset custodians regulated by the SEC.

Investors must also receive information about the products and confirm their understanding of the associated risks before they can begin trading. Additionally, cryptocurrency ETFs must operate as passive investment vehicles designed to track the price movements of their underlying digital assets.

Each fund must maintain an average net exposure of at least 80% of its net asset value to a single cryptocurrency over the course of an accounting year. These requirements establish a framework for how cryptocurrency ETFs must be structured, managed and offered to investors in Thailand.

Market adoption will depend on fees and investor education

Although the regulations create a new opportunity for cryptocurrency investment through Thailand's stock market, industry participants believe the success of these products will depend on their competitiveness and accessibility. “Whether these products draw meaningful investment will depend on a few things: competitive fees, tight tracking of the underlying asset, and investor education,” Fuwattananukul said.

The finalized rules follow several rounds of public consultation conducted by the SEC throughout 2026. The regulator initially sought feedback on the proposed framework in April and May, followed by consultations on draft regulations during August and September.

According to the SEC, most respondents supported the proposals, contributing to the framework's finalization and implementation in October. The introduction of locally listed Bitcoin and Ether ETFs represents another step in Thailand's development of regulated cryptocurrency investment products, potentially expanding access to digital assets through established financial market infrastructure.
