BREAKING: SEC Motion to Seal Documents Denied in Win for Ripple

The XRP vs. SEC battle seems to have triumphed Ripple once and for all. United States District Judge Analisa Torres denied the United States Securities and Exchange Commission’s (SEC) motion to seal internal documents, which is seen as a win for Ripple, XRP fanatics and the wider crypto community.

In December of 2022, the SEC filed a motion to seal internal emails, text messages and expert reports after former SEC director Willian Hinman delivered a speech, arguing that its mission outweighed the “public’s right” to access documents which have “no relevance” to the judgment decision.

The judge of the U.S. District Court ruled that the internal documents of the SEC are “judicial documents” which are subject to a strong presumption of public access. Judge Torres also added: “The Hinman Speech Documents are not protected by the deliberative process privilege because they do not relate to an agency position, decision or policy.”

Moreover, the court has granted the SEC with two of their requests which asked for the redaction of names and identifying information of SEC experts and Ripple’s XRP investor declarants, alongside the concealment of personal and financial information of the defendants.
