The US Senate failed to advance the Digital Asset Market Clarity (CLARITY) Act, dealing a setback to efforts to establish a comprehensive federal regulatory framework for digital assets.

A cloture motion on proceeding to the legislation received 49 votes in favor and 50 against, falling short of the 60 votes required to move forward to debate in the Senate. The procedural defeat was not a final vote on passage of the bill.

CLARITY Act stalls in the Senate

With limited legislative time remaining before a new session of Congress begins in 2027 following November’s midterm elections, the bill faces significant uncertainty over whether it will receive further consideration this year.

The setback leaves key questions surrounding federal crypto regulation unresolved, including how oversight responsibilities would be divided between the Commodity Futures Trading Commission and the Securities and Exchange Commission. The legislation had already faced difficulties before Congress’ August recess, particularly over proposed ethics provisions covering digital asset activities by government officials and their families.

Ethics and state enforcement concerns weigh on bill

Ahead of the vote, changes were made to address some concerns over ethics and enforcement. However, opposition remained over whether the provisions went far enough, while other concerns included the role of state authorities in enforcing crypto-related rules.

The failed vote leaves the future of comprehensive federal crypto market structure legislation uncertain, while the SEC and CFTC continue to operate under their existing authorities.

Crypto market falls following vote

Digital asset prices declined around the Senate vote, with Bitcoin falling below $76,000 and crypto-related stocks also recording losses. Reports differed on the exact magnitude of Bitcoin’s decline depending on the measurement window, but the broader market reaction was negative.

The Senate result means the CLARITY Act remains stalled unless lawmakers bring the measure back for reconsideration or pursue another legislative path.
