US Senate Republican leaders are expected to leave Washington for the August recess without voting on crypto market structure legislation, pushing consideration of the bill to at least September, according to Politico.

Senate Majority Leader John Thune confirmed that the chamber will not take up the legislation before the recess, citing a lack of Democratic support and saying the issue will be prioritized when lawmakers return. “The Dems are insistent on no Clarity vote,” Thune said, according to comments provided by his office to Cointelegraph. “I worked with sponsors of the bill. Senator Lummis was great, and we’re getting that queued up first thing when we come back.”

The delay leaves one of the crypto industry’s most important legislative priorities unresolved and gives the Senate less time to advance the measure later this year. Without enough Democratic backing, Republicans could struggle to reach the 60 votes typically required to overcome a filibuster.

Crypto Council for Innovation CEO Ji Hun Kim described the postponement as “disappointing” but said the broader direction of the legislation remained unchanged. “Every day without such a framework pushes American users and builders offshore and leaves consumers at risk,” Kim said.

September delay tightens the timeline

Thune’s comments follow remarks from Senate Banking Committee Chair Tim Scott, who said on Thursday that the Senate should hold its first vote on the CLARITY Act before the recess “without any question.” Scott argued that there was still time to schedule a procedural vote and said Republicans were making progress in building support.

The CLARITY Act is designed to establish a federal regulatory framework for digital asset markets and define how oversight should be divided between the US Securities and Exchange Commission and the Commodity Futures Trading Commission. Politico reported, citing three people familiar with the negotiations, that the legislation currently lacks sufficient Democratic support, although talks are continuing.

Thune could still file cloture before lawmakers leave. That procedural move could prepare the bill for a vote when the Senate returns in mid-September, but it would not amount to an actual vote on the legislation.

Democratic support remains a key hurdle

According to the report, Democrats have declined to agree to a time arrangement that would speed up the Senate’s remaining pre-recess business and create enough room for the crypto bill to reach the floor. Republican leaders would reportedly need unanimous consent from all 100 senators to clear the remaining agenda without extending the session well into the following week.

The delay means negotiations will continue during the recess, with the CLARITY Act expected to return as a priority when lawmakers reconvene in September.
